Brand Indicators is committed to protecting your privacy. By accessing the Site, you are consenting to the information collection and use practices described in this Privacy Policy.

Privacy Shield Commitment

Brand Indicators complies with the requirements of the U.S.-EU Privacy Shield Framework, as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Information from European Union member countries. Brand Indicators adheres to the Privacy Shield Principles of notice, choice, onward transfer, security, data integrity and purpose limitation, access and recourse, enforcement and liability with respect to all Personal Information transferred from the EU to the US within the scope of its Privacy Shield certification.

Collecting Your Personal Information

“Personal Information” is information that enables us to identify you. Examples of this kind of information include your name, title, company or organization name, email address, mailing address (work or home), information about your job function, information about your company, and other similar kinds of information that may be used for the same purpose. We will ask you when we need Personal Information which allows us to contact you to provide a service or carry out a transaction that you have requested such as requesting information about Brand Indicators, ordering e-mail newsletters, joining Brand Indicators, signing up for an event or training. When you register for an online event or resource on our site you are asked for your name, email address, and job title. Although the event registration page has the same look and feel as www.brandindicators.org you may actually be submitting registration information to our third party service provider who then shares the information back with www.brandindicators.org in order to fulfill your registration request. Please note that our Privacy Policy does apply and that our service provider must treat your Personal Information in accordance with our Privacy Policy. Your security is important to our third party service provider. The Site may collect certain anonymous information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the date and time you access the Site; the pages that you access while at the Site and the Internet address of the Web site from which you linked directly to our site. This information is used to help improve the Site, analyze trends, and administer the Site.

The Personal Information collected through our offline forms will be used to operate the Site and to provide the service(s) or carry out the transaction(s) you have requested or authorized. Brand Indicators uses Personal Information including (i) data received from the EU, and (ii) data received from online, offline, and/or in connection with products and services primarily for: (1) enabling and providing its website(s), products, or services (as for any other purposes as may be further set forth in agreements between Brand Indicators and its customers, including acting as a data processor on behalf of its customers which act as data controllers); (2) customer service activities, including processing orders, providing technical support, and customizing, enhancing, upgrading and improving Brand Indicators websites and offerings; (3) sales and marketing activities and customer relationship management (including newsletters and notices); and (4) internal business processes and management, crime/fraud detection and prevention, security, protecting Brand Indicators legal rights, and compliance with governmental, legislative, and regulatory requirements
Without limiting the foregoing, in support of these uses Brand Indicators may use Personal Information to provide you with more effective customer service, to improve the Site and any related Brand Indicators products or services. We may use your Personal Information to provide you with important information about the product or service that you are using, including critical updates and notifications. Brand Indicators occasionally hires other companies, consultants and contractors to provide limited services on our behalf, such as Web site hosting, packaging, public relations, mailing, answering customer questions about products and services, and sending information about our products, special offers and other new services. Brand Indicators may disclose Personal Information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on Brand Indicators or the Site; (b) protect and defend the rights or property of Brand Indicators or (c) act in urgent circumstances to protect the personal safety of Brand Indicators employees or agents, users of Brand Indicators products or services, or members of the public. We will retain your information for as long as your account is active or as needed to provide you services. Information Sharing and Disclosure

Brand Indicators will not sell or rent your Personal Information to anyone.
Brand Indicators will send Personal Information about you to other companies or people when:
1. We have your consent to share the information;
2. We need to share your information to provide the product or service you have requested;
3. We need to send the information to companies who work on behalf of Brand Indicators (e.g. affiliates, distributors or resellers) to provide a product or service to you or for further follow-up related to your interests.
4. We have to disclose your Personal Information in respond to a lawful request by public authorities and agencies, to meet any applicable law and regulation or to protect Brand Indicators’ assets as permitted by law.
5. We are subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). Cross-Border Transfer

Notwithstanding any other provision contained in this Privacy Policy, Brand Indicators complies with the requirements of the U.S.-EU Privacy Shield Framework, as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Information from European Union member countries. Brand Indicators adheres to the Privacy Shield Principles of notice, choice, onward transfer, security, data integrity and purpose limitation, access and recourse, enforcement and liability with respect to all Personal Information transferred from the EU to the US within the scope of its Privacy Shield certification. If there is any conflict between the terms in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Brand Indicators continues to adhere to the U.S.-EU Safe Harbor Framework as set forth by the U.S. Department of Commerce, which will not be affected by the participation in the Privacy Shield Framework.

Certain Personal Information may be subject to more specific privacy policies of Brand Indicators, which are also consistent with the requirements of the U.S.-EU Privacy Shield Framework.

Brand Indicators also collects Personal Data concerning its employees and candidates for employment (Human Resources Data) in connection with administration of its human resources programs and functions and for purpose of communicating with its employees. Brand Indicators also applies the EU-U.S. Privacy Shield Principles to this data. Further information in this regard can be found in Brand Indicators’ Human Resources Privacy Policy available for employees by contacting Brand Indicators’ Human Resources (HR) department.

Unless we tell you differently, companies who work on behalf of Brand Indicators do not have any right to use the Personal Information we provide to them beyond what is necessary to assist us. Brand Indicators ensures that those companies are contractually bound to confidentiality and use the data received on behalf of Brand Indicators in line with this Privacy Policy and guarantee an adequate level of data protection. Brand Indicators we will remain liable for any failure by the third party that receives Personal Information on behalf of Brand Indicators, unless we prove that the event giving rise to the damage was solely caused by the third party.

Control of Your Personal Information

Except as otherwise described in this statement, Personal Information you provide on the Site will not be shared outside of Brand Indicators without your permission.

Brand Indicators is committed to protecting the security of your Personal Information. Dispute Resolution

If you believe your Personal Information has been used in a way that is not consistent with this Policy, we invite you to contact Brand Indicators first under reply@brandindicators.org. We will make all efforts to resolve your complaints timely and accurately. Further, Brand Indicators has committed to cooperate with EU Data Protection Authorities (DPAs) and to comply with the information and advice provided to it by an informal panel of DPAs in relation to such unresolved complaints as determined by the Privacy Shield Principles.

Under certain conditions, EU individuals may seek redress from the Privacy Shield Panel, a binding arbitration mechanism.

Changes to this Privacy Statement

We may occasionally update this Privacy Policy. When we do, we will also revise the “last updated” date at the top of the Privacy Policy. For material changes to this Privacy Policy, we will notify you either by placing a prominent notice on the homepage of our website or by directly sending you a notification prior to the changes taking effect. We encourage you to periodically review this Privacy Policy to stay informed about how we are helping to protect the Personal Information we collect.
